AMENDMENT OF THE GENERAL WORK AGREEMENT FOR PASSENGER TRANSPORT

The general labor agreement for passenger transport has been amended on 8.02.2021 as follows:

The Association of Automobile Companies, registration code 80018037 (hereinafter AL), represented by the chairman of the board Andrei Mandla and the Estonian Transport and Road Workers' Union, registration code 80043986 (hereinafter ETTA), represented by the chairman of the board Ullar Kallas.

Considering the significant restrictions imposed on the normal functioning of society and the economy due to the spread of COVID-19, which have, among other things, an impact on the survival and competitiveness of companies, AL and ETTA decided:

1.Amend § 3 of the General Employment Agreement for Passenger Transport signed on 13.01.2020 and word it as follows:

§ 3 Validity of the General Employment Agreement

1.The General Employment Agreement enters into force on 13.04.2020 and is valid until 31.03.2025.

2.Amend § 2 and 3 of Appendix 1 § 2 and 3 of the Passenger Transport General Employment Agreement concluded on 13.01.2020 and word them as follows:

§ 2 From 01.04.2021, the gross salary of bus, trolley and tram drivers working on the basis of the Association's operating license, route license and public service contract shall be at least 1,100 in case of full-time employment € per month (minimum monthly fee).

§ 3 As of 01.01.2022, the gross salary of bus, trolley and tram drivers working on the basis of the Association's activity license, route license and public service contract is at least €1,150 per month (minimum monthly salary) in case of full-time employment.

3.Add §§ 4-7 to Appendix 1 of the Passenger Transport General Employment Agreement concluded on 13.01.2020 and word them as follows:

§ 4 From 01.06.2022, the gross salary of bus, trolley and tram drivers working on the basis of the Association's operating license, route license and public service contract in case of full-time employment at least €1,200 per month (minimum monthly fee).

§ 5 As of 01.01.2023, the gross salary of bus, trolley and tram drivers working on the basis of the Association's activity license, route license and public service contract is at least €1,250 per month (minimum monthly salary) in case of full-time employment.

§ 6 From 01.01.2024, the gross salary of bus, trolley and tram drivers working on the basis of the Association's activity license, route license and public service contract is at least €1,300 per month (minimum monthly salary) in case of full-time employment.

§ 7 Starting from 01.04.2024, the gross salary of bus, trolley and tram drivers working on the basis of the Association's activity license, route license and public service contract shall be at least €1,350 per month (minimum monthly salary) in case of full-time employment.

The change is valid from 01.04.2021.

DRIVER TRANSPORT GENERAL WORK AGREEMENT

GENERAL PART I

1. Scope of the general employment agreement

1.The general labor agreement is a collective agreement between the Association of Automobile Companies (hereinafter AL) and the Estonian Transport and Road Workers' Union (hereinafter ETTA), representing the basic level of the system of agreements, which does not exclude the agreement of more favorable conditions in collective agreements at the company level (hereinafter Collective Agreement, together with the General Labor Agreement - Agreements).

2.The general labor agreement regulates the employment, professional and social relations of persons engaged in bus transport of passengers belonging to the Union of Automobile Companies (hereinafter referred to as the Employer) and members of the Estonian Transport and Road Workers' Union (hereinafter referred to as the Employer) under the collective name Parties.

2. Availability of Agreements

1.The general employment agreement is publicly available on ETTA's and AL's internet websites.

3. Validity of the general employment agreement

1.The general employment agreement enters into force on 13.04.2020 and is valid until 31.03.2023.

4. Application of extension

1.The working and rest time conditions and the remuneration conditions set out in the general labor agreement extend to and are mandatory for all employers and employees engaged in the bus transport of passengers within the meaning of the Public Transport Act and hiring labor for this purpose, regardless of the type of contract concluded with them.

II. WORKING AND REST TIMES

5. The length of the employees' working week and shift

1.The regulation of working and rest time is based on the Traffic Act, Regulation (EC) No. 561/2006 of the European Parliament and Council, Regulation (EU) 165/2014 of the European Parliament and Council, Directive 2002/15/EC of the European Parliament and Council and the Employment Contracts Act.

2.The Employee is expected to work 40 hours per week. In cases arising from the law, the weekly working time can be extended to 60 hours if the average working time calculated during four months does not exceed 48 hours per week.

3.If the Employee's working time in a working day is up to three hours, he is paid for three hours, and three hours are also included in the working time. A working day is the time between two daily rest periods.

4.The working day immediately preceding a national holiday is shortened by at least one hour, and in the cases provided for in § 53 of the TLS by at least three hours.

6. Special conditions (for bus, tram and trolley drivers) regarding working and rest time

1.The employee is given a break of one to one hour during the working day for rest and meals.

2.Due to the nature of the work, a full-time employee may be given no more than one break of 3 hours or more during the working day if all the following conditions are met:

1. the corresponding agreement is included in the company's collective agreement and

2. for the break, starting from its third nour, a fee equal to at least the basic wage or an equivalent difrerent wage agreed in the collective agreement is paid, and

3.the break includes the break for rest and meals provided in point 1

1.The break within the working day stipulated in points 1 and 2 is not included in the working time.

2.Employees whose main job is to drive a motor vehicle carrying passengers with more than nine seats (including the driver's seat),

the duration of annual leave with additional leave is at least 35 calendar days.

III. EMPLOYMENT

7. Basis for determination of remuneration

1.The minimum wage rates for employees are given in Appendix 1 of the General Employment Agreement. The minimum monthly

wage includes the fees agreed in the collective agreement and the employment contract or other fees established by the employer.

8. Payment of overtime pay and pay for working on public holidays

1.If the calculation period of the accumulated working time is 1 to 2 months, the Employee is paid overtime in accordance with the

Employment Contracts Act. In the case of a 3- to 4-month accounting period, the Employee is paid 1.6 times the salary.

2.Overtime pay and pay for working on public holidays are not included in the monthly fee for the agreed working hours (standard hours).

IV. SOCIAL GUARANTEES

9. Calculation of the duration of employment with the same Employer

1. If an employee starts working again with the same Employer within three years after the termination of the previous employment relationship, the duration of the employment relationship before the termination of the employment contract shall include the time worked without breaks for the same Employer, when the employment contract was terminated:

- Due to dismissal at the initiative of the employer (TLS § 89 subsections 1 and 2);

- At the initiative of the employee due to the violation of the terms of the contract by the employer (TLS § 91 subsection 2);

- On the employee's initiative for a reason arising from the employee's identity (TLS § 91 subsection 3);

- At the initiative of the employer due to long-term incapacity for work (TLS § 88 lg. 1 p. 1).

10. Rest conditions for drivers (bus, tram and trolley drivers).

1. Sanitary, living and resting conditions for bus drivers are ensured at the end points of regular passenger transport lines.

11. Further training of employees

1. The employer trains at his own expense Employees who are required by the Road Transport Act to undergo a fixed-term refresher training for bus drivers.

V. RELATIONS BETWEEN THE EMPLOYER AND THE UNION

12. Calculation of membership fees

1.The calculation of the membership fee from the wages of the members of the trade union to the extent approved by the trade union and the transfer to the account of the trade union is carried out by the Employer's accounting.

2.The trustee informs accounting of changes in the list of members.

13. Participation in trade union meetings, training and the work of trade union bodies

1.Trade union meetings are held at a time that does not involve interruption of the work process.

2.Based on written invitations submitted by the union, the employer allows a trade union member at least five days off work per year to participate in training organized by the trade union or in the work of trade union bodies, provided that this does not entail significant obstacles to the employer's economic activities. On the days off from work granted on the basis of this point, the employee's average salary for two days per year is preserved. The Trustee and the Employer agree on the deadline for submitting the written invitation.

14. Trustees and general trustee

1. Employees have the right to elect one trustee for each subdivision if they are located in different localities or districts. [...]

2.If several trustees are elected, the general meeting of the trade union may choose a chief trustee from among them, who represents all members of the department, unless otherwise agreed in the Collective Agreement.

VI. FINAL PROVISIONS

15 Registration, extension and appendices of the general employment agreement

1.The Estonian Transport and Road Workers' Union submits the general labor agreement for registration in the collective agreement database of the Ministry of Social Affairs.

2.The parties jointly turn to the Minister of Social Affairs with a proposal to expand Chapters II Working and Rest Time and III Remuneration of the General Labor Agreement in accordance with Section 4(4) of the Collective Agreement Act.

3.The text of the general labor agreement is drawn up in two copies with equal legal force, one of which remains for each signatory.
